The website concerns the advertising of The Villa GEMS tourist accommodation based in Roussospiti, Rethymno on the island of Crete. The Villa GEMS is a privately owned villa and it is rented according to the Greek Law 4446/2016.
The legal terms and conditions that apply between all of our clients or prospective clients and The Villa GEMS is the same to each of you and their validity starts from the moment you make a reservation to our villa.
In order to make a booking in The Villa GEMS, it is required that the client is at least 18 years of age. It is required to send us a copy of your Identity/Passport in order to make the booking to The Villa GEMS. It is mandatory to deposit 50% of the total amount of the booking fee. The other 50% is paid in full on the first day of the client’s arrival.
In case of a cancellation made by the client or in case of a no show, The Villa GEMS holds the prepaid 50% of the booking fee and this is non-refundable.
In case of a cancellation made by the owners of The Villa GEMS, the entire booking fee is refundable.
The clients of The Villa GEMS are responsible for their own acts and omissions and are also responsible for the acts and omissions of anyone they invite to join or provide access to The Villa GEMS. This signifies that the clients are liable (a) for complying with The Villa GEMS house rules, (b) for leaving the property of The Villa GEMS in the condition it was in when they arrived, (c) for paying all Damage Claim amounts necessary to cover damage that the client(s) or their pet(s) caused to The Villa GEMS, and (d) the clients are obliged to act with integrity, treat others with respect and comply with applicable laws at all times. In case the client(s) bring a minor to The Villa GEMS, they must be legally authorized to act on behalf of the minor and they are solely responsible for the supervision of that minor.
During your stay at The Villa GEMS you should take care of the villa like it was your own property. Any damage caused by the client or by the client’s pet(s), the client is held liable for compensation. The client is responsible for legal fees to Greek Courts in case the owners of The Villa GEMS decide to bring the matter for damaged property in Court.
These Terms are governed by and construed in accordance with Greek law. If you are acting as a client of The Villa GEMS or as a legal entity or business, you agree to submit to the exclusive jurisdiction of the Greek Courts.
Caution: We take all reasonable steps to ensure the security of information. However, it is known – and we draw your attention – to the possibility of Electronic/Internet Fraud regarding emails. Whenever you have the slightest doubt about an email that you may have received from The Villa GEMS, we kindly ask and recommend that you do not reply or open any attachments. It would be wise to give us a call informing us of any concerns you may have so that we can enhance our knowledge in dealing with any illegal activities.

The personal data of the clients of The Villa GEMS (name, surname, email address, residential address, telephone number, ID, passport, etc.) are considered confidential. Users, when providing their information in the context of their communication, consent and accept the imminent processing of these personal data for the needs of smooth communication/transaction between the parties. It is ensured that only the owners of The Villa GEMS have access to this information and only when necessary, e.g. to process booking requests. The Villa GEMS undertakes not to disclose the details of the customers and their transactions, unless it has a written authorization from them, or this is required by a Court decision or a decision of another Public Authority.
Attention: not all personal data is sensitive, it is defined by the law, where you can refer it.
To ensure the confidentiality of the data transferring, the SSL-128bit encryption protocol is used.
All communication between the user’s computer and The Villa GEMS website is encrypted using a 128-bit key.

We retain this data for as long as we manage your booking request and until you request its deletion and/or delivery while we reserve the right to retain electronic messages between us for five (5) years after the completion of your accommodation in The Villa GEMS with for the purpose of any probative force thereof regarding the services provided and the financial and/or other agreements between us.
